Judge denies request to dismiss two charges against Harvey Weinstein

Judge rules against Weinstein

A Los Angeles judge has rejected movie mogul Harvey Weinstein's efforts to dismiss two sex-related charges against him, even though his lawyers claim they are precluded by the statute of limitations.

The disgraced producer, who is already serving 23 years for sex offenses in New York, appeared for a hearing on Thursday (29Jul21) at the Foltz Criminal Justice Center in Los Angeles, where Judge Sergio Tapia decided to let the two charges against him stand.

But Weinstein did land a small win - the judge also told prosecutors to return to a grand jury to amend a third charge of sexual battery by restraint on statute of limitations grounds.

Weinstein is currently facing nine sex-related charges in California, where he has been held without bail since his extradition from New York earlier this month (Jul21). He has pleaded not guilty to all the Los Angeles charges.

The Weinstein indictment details four counts each of forcible rape and forcible oral copulation, two counts of sexual battery by restraint, and one count of sexual penetration by use of force.
