Judge to decide whether a man Tasered a woman during Enderby home invasion

Did man Taser a stranger?

The fate of a man accused of Tasering a stranger in the neck during a home invasion last year is now in the hands of a judge.

Christopher Hubley stood trial in B.C. Supreme Court in Kamloops on one count each of break-and-enter, robbery, assault causing bodily harm and assault with a weapon. His trial ended on Friday.

He was charged in connection with an April 12, 2020, incident at a home in Enderby.

Hubley is alleged to have shown up at the house that day with Brittney Galbraith and an unidentified third person. Galbraith had recently moved out of the house and was there to retrieve some of her belongings.

Court heard a woman in the house was struck with a conducted-energy weapon after opening the front door — allegedly by Hubley.

“When the male came through the door, there was a Taser in the male’s hand and he hit it to the left side of her neck,” Crown prosecutor Danika Heighes said Friday in her closing submission.

The woman testified at Hubley’s trial and said the jolt from the weapon sent her “flying” back into a table.

“She also described the sound of the object that hit her neck as a ‘buzz’ electrical sound,” Heighes said.

“[She] described the feeling of the object that hit her neck as, ‘I felt a shock go through my whole body.’”

The woman said she didn't know Hubley prior to the incident. Another person in the house said Hubley stole his cellphone to prevent him from calling the police.

Galbraith was also charged following the incident and has since pleaded guilty. She is expected to be sentenced next month in Salmon Arm provincial court.

Galbraith spent Monday night in jail after being held in contempt for refusing to answer questions from Heighes. She returned on Tuesday and decided to co-operate.

Lawyers are expected to return to court on Sept. 27 to set a date for a decision from B.C. Supreme Court Justice Dennis Hori.

Hubley remains behind bars.
