Merritt man released from prison after doubt in 25-year-old murder conviction

Release from jail after doubt

A judge has ordered a man convicted of murder in the 90s to be released following concerns there was a miscarriage of justice.

CTV News Vancouver is reporting Gerald Klassen, who's now 60, has been ordered released from federal prison. He was convicted in the 1993 death of Julie McLeod, who was found partially submerged at a Nicola Lake boat ramp.

Klassen maintained the two had sexual intercourse and he pushed her, but never admitted to guilt in McLeod's death.

“Mr. Klassen has acknowledged that his conduct was reprehensible,” said Madam Justice Catherine Wedge Thursday morning. “But it was not sexual assault and it was not murder.”

The UBC Innocence Project became involved in the case and determined that the pathologist's findings (stating McLeod had been beaten) at the time may have been incorrect.

The case is to be reviewed by the federal minster of justice to determine if there was a miscarriage of justice.

In the meantime Klassen, who spent more than 25 years in prison because he wouldn't admit to murder, has been released to a family friend.
