Kelowna man wants justice, claims RCMP didn't take case seriously

Kelowna man alleges assault

A Kelowna man says he has lodged a formal complaint with the Office of Police Complaint Commissioner following what he describes as two attacks that occurred on his own property Tuesday night.

Mikael Mikkelsen posted photos and allegations on social media, against a Kelowna RCMP officer (which he has since taken down) following a bizarre incident.

Mikkelsen alleges he was cut off on his motorcycle by another driver while coming out of his Discovery Bay residence. The pair exchanged words and then went their separate ways.

Mikkelsen then alleges he was sitting on his deck at approximately 8:30 p.m. when the same man accosted him and began punching him in the head.

"He hit me and put me in a head-lock. I was able to get out before he got me onto the ground and then he took off. I didn't fight back."

Mikkelsen claims assailant fled across the street into the Waterscapes development.

"I followed him because I wanted to know where he was going. At the same time we had the cops on the phone," Mikkelsen says.

RCMP showed up and spoke with both parties and determined it was a consensual fight, a determination that Mikkelsen strongly disagreed with, "absolutely it was not a consensual fight."

But that wasn't the end of the incident. Mikkelsen then alleges four masked men came back to his property about an hour later and assaulted him again. "One of them throws his motorcycle helmet at me. I took off down the street, found a bystander, and yelled call the RCMP."

Mikkelsen says he believes the men were looking for the first attacker's phone which they believed had been left on Mikkelsen's property. Mikkelsen admitted he had found the phone and returned it to one of the men after determining that was what they were after. "It was sitting in the bushes. When the guy jumped over and attacked me he lost his phone and his hat."

RCMP returned to the scene and Mikkelsen says was disappointed with the response a second time.

"I expected the RCMP to come and protect us and the assailant ended up walking off with these four other guys and we were told to disperse and stay away from each other."

Mikkelsen says he has multiple contusions and a concussion as a result of the altercation.

RCMP confirm they attended a disturbance call in the 1000-block of Sunset drive after a confrontation between two adult men. RCMP tell Castanet they attended the scene on two more occasions, as the individuals involved continued to verbally confront each other.

"This investigation is in its early stages with multiple allegations made by both individuals. Like any other investigation, public safety is the RCMP's top priority," said Const. Solana Paré.

Mikkelsen isn't content to let the matter go, suggesting he'll be filing a civil lawsuit against the first attacker and filing a complaint with the independent complaints commission.

Mikkelsen has been told as of Thursday that his complaints are being investigated, but Mikkelsen remains unsatisfied, "my concern is the gross negligence and misconduct of the officer involved."
